Karen, thank you for discussing the issue of AI and copyright. I find it deeply concerning. Big tech is weaponizing Fair Use doctrine of US copyright law, focusing on the “transformative nature of AI.” Artists and creatives are also using an aspect of Fair Use—Effect on the market value of the original work, meaning whether the use harms the copyright owner’s ability to profit. No doubt it does/will, but loss of income is very hard to prove. Just recently, former Google exec and UK Deputy Prime Minister, Nick Clegg claimed that asking AI companies to seek permission before using copyrighted works will “kill the industry.” Big Tech in the US is counting on its deep pockets in court. Why not use AI to figure out a method for obtaining consent, giving credit and compensation? We figured it out with digital music distribution. The implications for all artists and creatives could be devastating.

Hopefully when the dust settles, the attempts at misuse of ‘fair use’ will stop. I like your idea of using AI tools to help find solutions for Consent, Credit, and Compensation!
